Renters are responsible for any and all damages caused by their puppy after they take their puppy home or to someone else's home!
Before placing an electronic deposit on a puppy, please review my Health Guarantee and completed the Puppy Questionnaire. Submitting an electronic deposit confirms your agreement to the terms and conditions outlined in this contract.
** All puppies here at LAAT WEIMS will leave on a spay/neuter contract with no exceptions! Proof of your dog's spay/neuter will be required to release your limited AKC papers to you. {This will be in effect starting June 1, 2023}
Health Guarantee
Buyer has paid a deposit of $200.00 electronic payment through Good Dog, and the balance is due upon release of the puppy/dog to Buyer. Payment of the balance must be made by CASH only, (unless arrangement has been made prior). The buyer acknowledges and agrees the deposit is non-refundable along with any money sent electronically (including fees for mileage). Buyer will forfeit the deposit and any rights to the puppy/ dog if; Buyer fails to complete the purchase of the puppy/dog for any reason.
If in the event that the puppy/ dog is not available to be sold due to sickness meaning an active illness, infection, disease, injury, or medical condition requiring veterinary treatment, prescription medication, hospitalization, surgery, or other medically necessary intervention or death, the Buyer can choose another puppy from a current litter that I have that is the same age. If Buyer does not want to move forward with getting a puppy at all or from any current litters that i have or that is due than the deposit is not refundable.
Seller represents and warrants to Buyer that Seller is the legal and true owner of the puppy/dog and that Seller has full right and authority to sell the puppy/dog. The puppy/dog is being sold free and clear of any lien, security interest, charge or other encumbrance. Seller does not assume responsibility for any other veterinary bills or other expenses incurred by the purchaser/buyer on behalf of the puppy/dog after the puppy/dog has left possession of the Seller. Seller guarantees that the puppy/dog is AKC purebred Weimaraner, offspring of the purebred Sire and purebred Dam.
Buyer has three (3) calendar days from the date the puppy leaves Seller's possession to have the puppy examined by a licensed veterinarian at Buyer's expense. If the veterinarian determines that the puppy has a serious illness or medical condition that was present at the time of transfer and renders the puppy medically unfit for purchase, Buyer must immediately notify Seller and provide the complete veterinary examination report, diagnosis, test results, and invoice. If Buyer seeks to return the puppy under this Health Guarantee, Seller may require confirmation of the same condition by a second licensed veterinarian. Both examinations, testing, and related expenses shall be at Buyer's expense. Any refund If given will be subject to the terms of this Agreement and applicable Virginia law.
This Guarantee does not cover any illness, infection, parasite, or communicable disease contracted after the puppy leaves Seller's possession, including but not limited to Parvovirus, Giardia, Coccidia, kennel cough, canine influenza, or other communicable diseases or parasites. Buyer assumes responsibility for the puppy's environment, exposure, care, and veterinary expenses after transfer. A diagnosis made during the three-day examination period does not, by itself, establish that the condition existed prior to transfer. Claims that a condition existed at the time of transfer must be supported by appropriate veterinary documentation.
Buyer must have the puppy examined within three (3) calendar days of transfer and must notify Seller of any claim under this Health Guarantee within twenty-four (24) hours of receiving the veterinarian's diagnosis. Complete veterinary documentation must be provided to Seller within seven (7) calendar days of the puppy's transfer. The detection of an abnormality or veterinary finding does not, by itself, mean that the puppy is sick, medically unfit for purchase, or has failed its veterinary examination. The examining veterinarian must determine whether the finding constitutes an active medical condition requiring treatment and whether it renders the puppy medically unfit for purchase or transfer.
The puppy/dog will have been vet checked, dew claws removed, tails docked (unless requested the tail and dew claws be left on - or Seller deems puppy too small to have the procedure done around 3-5 days old) the puppy/dog will have its first set of shots, dewormed, microchipped with Fi Nano (if available) and deemed in good health by a licensed veterinarian at the time of the sale. The puppy/dog will be up to date on all shots and deworming at the time of pickup. It is very important to continue the vaccinations and deworming to have a healthy and happy puppy/dog.
This Guarantee does not cover an innocent, physiologic, developmental, transient, or low-grade heart murmur that does not require medical treatment or render the puppy medically unfit for purchase. A heart murmur or other veterinary finding does not, by itself, constitute a diagnosis of congenital heart disease, cherry eye, entropion, allergies, colds, undescended testicles, stenotic nares, elongated soft palate, umbilical hernia, dermatitis, external or internal parasites, mange, puppy demodex, OFA evaluations, dew claw regrowth or under / overbite. Seller will NOT replace a puppy due to heat stroke, abuse/neglect, or improper socialization. The Buyer agrees to maintain preventative care of the puppy in regard to hip dysplasia, such as proper nutrition, proper exercise, and preventing stress injuries (i.e. not allowing the puppy to jump from heights taller than itself at the shoulder, no forced exercise such as running, until at least 12 months of age, no climbing of stairs, or anything else that would be strenuous to the hip joints.) The buyer further understands that this puppy is not being sold with a guarantee against Canine Hip Dysplasia, as that condition can be caused by environmental situations that are not within the control of the seller once buyer assumes possession. OFA- or Hip evaluations cannot be performed before the age of 2 years old. Buyer agrees that they have thoroughly researched the Weimaraner breed and understand the many health issues they can possess. The buyer is solely responsible for all medical costs of their puppy/dog. This guarantee covers only the original Buyer and is not transferable to anyone other than the sole and original Buyer. The breeder assumes no responsibility for training difficulties, behavioral problems, aggression, crate training, potty training, personal damages, property damages to rentals, homes, businesses, public places, etc. The Breeder assumes no responsibility for any and all behavior after the puppy/dog has left the Seller regardless of age, size, or training. The breeder does not guarantee size; there are too many variables and genetics to count for. The Seller can give the buyer an educated guess but can give nothing more than that.
** (NO BREEDING RIGHTS WILL BE GIVEN- *Limited AKC Registration, never to be used for breeding purposes, and to be spayed or neutered at the appropriate age. It does allow any and all placements into hunt and field tests, tracking, agility, companion dog etc. This puppy is being sold on Limited Registration. This means the puppy is to never be bred and is required to be spayed/neutered by 12 months. Proof of spay/neutered is required and needs to be sent to Seller. If a puppy is not spayed/neutered before the required 12 months, my entire warranty is nulled. If found that this puppy/dog is bred either intentionally or unintentionally, this contract is considered breached and buyer forfeits the puppy/dog back to Seller me the breeder, the entire litter and any money made from selling or rehoming will belong to LAAT WEIMS and the entire contract is void, and a separate monetary penalty of $5,000 will be issued to Buyer. The buyer will also be responsible for any court fees regarding breach of contract. No other registration of ANY KIND is to be done on the dog at any time during its lifetime. If the buyer registers the dog under another registry, the seller will be forced to take legal action! Buyer will have the Dog spayed or neutered by the age of 12 months old. No exceptions!
The puppy/dog will reside with Buyer as companion pet to Buyer and Buyer’s family. The buyer will keep the puppy/dog in an enclosed area of adequate size and will not allow the puppy/dog to roam at will. The buyer will provide the puppy/dog with nutritious food, flea and tick medications, including deworming regularly, heartworm prevention and regular vaccinations (including rabies). Buyer is not acting as an agent for any other person or business in the purchase of the puppy/dog. Buyer will not sell, give, or release the dog to a pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility, etc.
If any action or failure to act on the part of Buyer shall result in any claim, suit, loss, damage, injury, death, or liability, Buyer agrees to defend and hold Seller harmless and to pay all of Seller’s costs and expenses, including legal fees, any amount paid in settlement and any award or judgment with respect thereto. Buyer releases Seller from any and all liability, costs or damages caused by the puppy/dog after placement with Buyer, including but not limited to damage to or destruction. Any action or claim brought by Buyer against Seller for breach of this Agreement or for loss due to negligence must be brought within one (1) year of the date such claim or loss occurs and to the courts of Franklin County, Virginia courts only. If you, the buyer, decide you do not want the puppy/dog and want to return it at any point in the life you may do so with a minimum of 30 days' notice as I, the seller, will need ample time to prepare for the dog to be brought back to me. You, the buyer, will however have to drive to me completely to drop off the puppy/dog along with all the items that were given to you/ folder of all papers given to you as well. I, the seller, will take back any of my puppies or dogs at any point if they are no longer wanted or if the Buyer is no longer able to keep them. I, the seller, do not issue a refund if they are brought back to me, unless it is a genetic issue (see above statement about having the puppy/dog seen by licensed veterinarians).
ALL genetic testing results of each parent are publicly posted on my website and can be viewed at any time. This Agreement shall be governed by and construed in accordance with the laws of Virginia. This Agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this Agreement.
